This is an English translation provided for convenience. The French version of these terms is the authoritative one (see article 33).
The essentials, in plain terms. Equiflow helps you organise your horse's life: health record and reminders, a suggested working week, competitions, advice, and Jo, an artificial intelligence assistant. It is not a vet, not a riding instructor and not an emergency service: the app never says what is wrong with your horse, never gives a treatment or a dose, and its sessions are general suggestions. Jo is an AI: it can be wrong. You remain responsible for your horse, your safety and your decisions. The app is reserved for people aged 16 and over; at 16 and 17, Jo and the subscription require the consent of a parent or guardian. Your data stays encrypted on your phone, except as described in the privacy policy. The Premium offer is optional and governed by the terms of sale. This summary does not replace the articles below.
These general terms of use (the "Terms") govern access to and use of the Equiflow mobile app. They form a contract between you and the publisher. If you do not accept them, do not install or use the App.
1. Definitions
- App: the Equiflow mobile app, for iPhone and Android, including its content, its updates and the online services associated with it.
- Publisher, "we": BAUGEY MATHEO, trading as DEVOLIM, identified in article 2.
- User, "you": any natural person who installs and uses the App, including a person invited to another user's horse.
- Jo: the App's character and the assistant that bears its name, whose answers, programmes and photo readings are generated by an artificial intelligence system supplied by a third party.
- Premium Offer: the optional paid offer giving access to additional features, governed by the terms of sale and subscription.
- Platform: Apple's App Store or Google's Google Play, which distribute the App and sell the Premium Offer.
- Your content: everything you enter or add in the App (profiles, health record, photos, documents, sessions, competitions, expenses, notes, messages to Jo, suggestions and reports).
- Shared horse: a horse whose profile owner has invited other users, under the conditions of article 14.
2. Publisher
The App is published by BAUGEY MATHEO, sole trader (entrepreneur individuel) trading as DEVOLIM, 248 rue de Bègles, 33800 Bordeaux, France, SIREN 948 000 757. Contact: contact.equiflow@devolim.fr. The legal notice supplements these Terms.
3. Purpose and applicable documents
The Terms set out the rules for using the App and the mutual commitments of the Publisher and the User. The health and safety disclaimer and the privacy policy form an integral part of them. If you subscribe to the Premium Offer, the terms of sale and subscription also apply; in the event of conflict on the sale, they prevail.
4. Acceptance
Before first use, the App shows you the health and safety disclaimer and asks you to accept the Terms by an explicit action; nothing is accepted by default. The version and date of your acceptance are recorded on your phone. In the event of a significant change, the App asks you to accept again (article 29). By accepting, you declare that you have read and understood the disclaimer and these Terms, and that you meet the minimum age.
5. Access conditions and minimum age
- Minimum age: 16. The App is not intended for people under 16, who must not use it. This threshold is the same in every country where the App is offered. A parent may use it to follow their child's horse. A parent or guardian who thinks a child under 16 is using the App may write to us.
- From 16 to 17, the consent of a parent or guardian is required before using Jo and before subscribing to the Premium Offer. The App asks for it before Jo is first used and before any purchase: you confirm, by an explicit action in the App, that a parent or guardian has read the information shown and has given their consent. This declaration, its version and its date are recorded on your phone. Without it, Jo is not available and no purchase is started; the rest of the App remains usable. Consent can be withdrawn at any time: withdraw your consent for Jo in Settings, cancel the subscription with the Platform.
- The App is free to download. It works without an account: no name, email address or password is asked of you. An anonymous technical session is created for online services.
- You need a compatible, up-to-date phone. Jo, the weather, sharing, sending messages to the team and purchases require an internet connection, at your own cost depending on your plan. The health record, reminders and the emergency screen work offline.
- The App is designed first for France: the vaccination rules for competing, entry closing dates and the Galop levels are those of the FFE. Outside France, this information may not apply; check local rules.
6. Description of the service
The App offers, in particular: your horses' profiles and health record (care, appointments, documents, photos, weight and condition, emergency card) with reminders; warning signs and an emergency screen to call your vet; a suggested working week and sessions, written or guided by voice; a journal and reports; an exercise library; tracking of your competitions; weather for riding; advice and the Jo assistant; sharing a horse with the people you invite; an encrypted backup and a lock. Some features are part of the Premium Offer. Features may change under the conditions of article 22.
The emergency screen, the warning signs, calling the vet and the health record of one horse remain available without a subscription.
7. Nature of the service: not a vet, not an instructor
The App is an organisation and general information tool. It performs no act of veterinary medicine: it does not determine your horse's state of health, makes no diagnosis, does not prescribe, name or dose any medicine, and does not replace your vet, nor an osteopath, an equine dentist or a farrier.
It provides no riding instruction, no personalised training and no supervision: its sessions and programmes are general suggestions, which no one checks for your horse or for you. They do not replace a qualified riding instructor.
The App's content (advice, exercises, reminders, programmes, Jo's answers and readings) is based on public and recognised sources, cited where possible, but does not take into account everything that makes up your horse's situation. No result is promised: the Publisher guarantees neither progress, nor level, nor competition results, nor your horse's health.
8. Your horse's health and emergencies
- The App is not an emergency service. It does not monitor your horse and alerts no one on your behalf: not your vet, nor the emergency services, nor your family, nor the Publisher. At the slightest doubt about your horse's health, call your vet or the on-call vet, without waiting for an answer from the App. For a person: 112 or, in France, 15 (SAMU), 18 (fire brigade), or 114 (for people who are deaf, hard of hearing or aphasic, and by text message for victims of violence).
- The warning signs displayed are indicative benchmarks, valid for an adult horse; every horse has its own. The App and Jo automatically detect certain warning words to prompt you to call your vet. This detection is an additional precaution, imperfect by nature: it may fail to recognise a serious situation, or trigger wrongly.
- Care reminders (vaccines, dewormers, dentist, farrier...) are suggested based on official sources where they exist, and remain editable. Your vet sets your horse's schedule. Dewormers and medicines are a matter for their prescription.
- Reminders rely on your phone's notifications, which may be delayed or blocked (settings, battery saving, permission withdrawn, change of phone). The Publisher does not guarantee their delivery.
- The App's record is a personal memory aid. It does not replace your horse's official identification document (passport), prescriptions, the entries the law reserves to the vet, or declarations to the IFCE.
- When the App copies a prescription, it adds nothing: only your vet's prescription is authoritative. Never start, stop or change a treatment without your vet.
9. The Jo assistant
Jo is an artificial intelligence system: when you write to it or entrust it with a photo, you are interacting with a computer program, not with a human being, a vet or an instructor. Its answers are generated automatically by a model supplied by a third party (OpenAI), based on instructions written by the Publisher. No one reads your exchanges live.
- Jo is only used after your explicit consent, collected in the App and revocable at any time (see the privacy policy). From 16 to 17, the consent of a parent or guardian is requested first (article 5).
- Jo is instructed never to say what is wrong with your horse, never to name or dose any medicine, to refer you to your vet at the slightest warning sign and to an instructor for learning. Its answers are also checked automatically. Despite these precautions, Jo may produce inaccurate, incomplete, outdated or unsuitable answers. They never constitute veterinary advice, instruction or professional advice. If an answer appears to break these rules, disregard it and report it.
- Content produced by Jo is labelled as such in the App. Check what it suggests, including the sources it cites, and use your own judgement.
- Access to Jo depends on the Premium Offer, under the conditions shown in the App. Where it is presented as unlimited, the conversation with Jo remains subject to reasonable use, whose limits (per day and per conversation) are shown in the App before any subscription: they prevent abuse and keep the service fast for everyone. Technical limits also protect the service against abusive or automated use. Jo may be temporarily unavailable (maintenance, provider outage, global limit reached): the emergency screen and calling the vet do not depend on Jo.
- You can report any answer or programme from Jo from within the App, without leaving it. Reports are reviewed to improve the assistant's safety.
- You are responsible for what you send to Jo. Do not include your name, information that could identify a person, or information about your health or anyone else's.
10. Reading photos and documents
When you ask, Jo reads a photo of your horse or of a document (passport, prescription, invoice, forage analysis, wound or discomfort) and suggests information to record. This reading is indicative: it may contain errors. Nothing is recorded without your validation; it is up to you to check each item before recording it. An estimate of body condition, weight or coat, or an observation about a wound, is never veterinary advice. Only photograph a person with their consent, and hide on a document anything not needed (name, address, numbers).
11. Programmes, sessions and safety on horseback
- Riding is a risky activity, for rider and horse alike. The programmes, sessions, exercises and distances offered are general suggestions, based on the information you entered, without anyone having seen your horse or how you ride. It is up to you to adapt, postpone or stop them, in particular at the slightest sign of fatigue, pain, lameness or fear, in your horse or in yourself.
- To learn or progress, for jumping, for a young horse, a difficult horse or one returning after an injury or a break, ride with a qualified riding instructor. An injured or convalescent horse only returns to work with your vet's agreement.
- The jump distances displayed are taken from the grids published by the Société hippique française, designed for horses in competition. They are never calculated by the AI and must be adapted to your horse, the ground and your level, under an instructor's supervision.
- The voice-guided session player only gives timings. Do not look at your phone in the saddle, keep the volume low enough to stay aware of your surroundings, and stay in control of your horse at all times.
- Ride with an approved, fastened helmet and equipment suited to your discipline. Before riding alone, tell someone. Take the weather and the state of the ground into account, whatever the forecast displayed says.
12. Competitions, rules and third-party data
- Competitions are entered by you. The App does not reproduce the FFE calendar and makes no entries: entries are made through the FFE's official services or your club.
- Calculated closing dates, vaccines to watch and documents to prepare are indications based on the FFE rules as at the date they were written. These rules change and the organiser may set other dates: only the rules in force, the competition schedule and your horse's passport are authoritative. The App never declares a horse fit to compete.
- Weather forecasts come from a third-party service (Open-Meteo) and are indicative.
- Equiflow is an independent app, with no link to the FFE, the IFCE, the SHF or the FEI (see the legal notice).
13. Your responsibility as rider and owner
You alone decide what you do for your horse and for yourself, with the help of the professionals of your choice. In particular:
- the Publisher never has custody of your horse. Liability for damage caused by a horse lies with its owner or with whoever is using it (article 1243 of the French Civil Code), depending on the circumstances; the App does not say who has custody in a given situation. It is up to you to be insured accordingly (third-party liability of the owner, the rider, the part-loaner);
- you are responsible for the accuracy of the information you enter: suggestions and reminders depend on it;
- you decide whether to follow a suggestion from the App or from Jo, after checking it, and taking into account the warnings that accompany it;
- you respect the rights of the people whose details or image you record (vet, farrier, part-loaner, instructor).
These reminders in no way reduce the Publisher's obligations or your rights as a consumer (article 24).
14. Sharing a horse
- You can invite other people to a horse's profile (for example a part-loaner, an instructor or your vet), with a role that determines what they see and can add, shown before the invitation is sent. Shared data is end-to-end encrypted: the Publisher cannot read it.
- The invitation takes the form of a code that you pass on yourself. This code gives access to the horse: only give it to the invited person. It expires if not used.
- You can remove a person at any time, and an invited person can leave a shared horse at any time. A removed person no longer has access to new content; the App cannot erase what they have already seen, copied or saved on their side.
- Only share with people you know. The Publisher checks neither the identity, nor the diplomas, nor the qualifications of invited people, who act under their sole responsibility.
- The invited person undertakes to use the horse's information only to look after it, not to disclose it and to respect its owner's privacy.
- Sharing does not change the horse's ownership, its custody or your arrangements (part-loan, livery, lease, loan). The schedule of who rides when is an organisation tool: it is not a contract. Settle these matters between you, preferably in writing, and check your insurance.
15. Professional users
If you use the App for your professional activity (riding instructor, riding centre, vet or other invited professional), you are not acting as a consumer. You declare that you hold the diplomas, authorisations and insurance your activity requires, in particular, for teaching, leading, supervising or training for payment, those required by article L.212-1 of the French Sports Code; the Publisher does not check them and presents no one as qualified. You alone are responsible for your advice, your acts and the data of your pupils or clients that you process. In your dealings with the Publisher, and except for gross negligence, wilful misconduct and personal injury, the Publisher's liability is limited to direct and foreseeable damage, up to the higher of the following two amounts: the sums you paid it in the last twelve months, or one hundred euros.
16. Data stored on the phone, backup and deletion
Your content is stored encrypted on your phone, not on the Publisher's servers (except as described in the privacy policy). It is neither backed up automatically to the cloud nor transferred to a new phone. As a result:
- loss, theft, breakage or reset of your phone, uninstalling the App or using "Delete my data" result in the permanent loss of your content, which the Publisher cannot recover;
- the App offers a backup encrypted with a password you choose. It is up to you to make it regularly, store the file safely and remember your password: without it, no one, not even the Publisher, can open the backup;
- an export you share (PDF of the record, document) is not encrypted and leaves the Publisher's control.
17. Lock and phone security
The App offers a lock by Face ID, fingerprint or code. You are responsible for the security of your phone (unlock code, system updates). Anyone with access to your unlocked phone can see your content if the lock is not enabled. The emergency screen remains available without unlocking the App.
18. Your content
You remain the owner of your content. For the content you choose to send only (messages and photos to Jo, items of a shared horse, suggestions, bug reports, reports), you authorise the Publisher and its providers to process it to the extent necessary to provide the service, ensure its security and improve it, under the conditions of the privacy policy, and for the duration of that processing. You guarantee that you have the right to use the photos and documents you add, and the consent of the people who appear in them. You undertake not to include illegal content.
19. Permitted use and prohibitions
In particular, you undertake not to:
- use the App in a way contrary to its purpose, to these Terms or to the law, or to the detriment of an animal's welfare;
- try to obtain from Jo a diagnosis, a prescription, a medicine dose or dangerous, hateful or illegal content, or divert it from its purpose;
- present the content of the App or of Jo as the opinion of a vet or an instructor, or resell it;
- add or share illegal content, or data about third parties without the right to do so;
- circumvent or attempt to circumvent protections, usage limits or access to the Premium Offer;
- extract, copy or reuse the App's content in an automated or massive way;
- decompile, disassemble or reverse-engineer the App, except where expressly permitted by law;
- disrupt the operation of the App or of its associated servers.
20. Reports and moderation
You can report any answer or programme from Jo from within the App, and report to contact.equiflow@devolim.fr any content you believe to be illegal, stating what it is and why. Reports are reviewed diligently and objectively. Jo's answers are filtered automatically before being shown to you. Since the content of a shared horse is end-to-end encrypted, the Publisher cannot read it: where a report justifies it, it can only end the sharing concerned. Any restriction taken against you (article 26) is explained to you, with its reasons and the means to challenge it, insofar as the Publisher can reach you.
21. Premium Offer
The App may offer a paid option (auto-renewing subscription and/or in-app purchase) giving access to additional features. The nature of the offer, its price, its duration, its renewal terms and, where applicable, whether a free trial is offered and for how long, are shown in the App and by the Platform before you confirm any purchase. Its subscription, cancellation, the right of withdrawal and the guarantees are governed by the terms of sale and subscription. From 16 to 17, subscribing requires the prior consent of a parent or guardian (article 5).
22. Availability and changes
The Publisher strives to keep the App working properly, but cannot guarantee continuous availability of online services (Jo, weather, sharing, purchase verification), which may be interrupted for maintenance, updates, technical incidents or a provider's failure. The health record, reminders and the emergency screen work offline.
The Publisher may change the App, add, modify or remove features, in particular to improve it, to comply with the law or an official rule, or to strengthen security, while respecting the rights you hold under the current Premium Offer and the statutory guarantee, and without making paid the features that article 6 guarantees without a subscription. If a change negatively and more than minimally affects your access to or use of the App, you are informed in advance and may terminate the contract under the conditions laid down by the French Consumer Code. If the App or the Premium Offer is permanently discontinued, the Publisher informs you in the App with reasonable notice, stops new subscriptions and gives you time to back up your data.
23. Intellectual property
The App and its elements (texts, advice, exercise sheets, illustrations, animations, audio recordings, interface, code, the character Jo and the App's name) belong to the Publisher or are licensed to it. These Terms grant you a personal, non-exclusive, non-transferable and revocable licence to use the App on your devices, in accordance with the Platform's rules. Third-party data (weather, distance grids, rules) remains subject to its own licences. Any unauthorised reproduction or exploitation is prohibited.
24. Publisher's liability
The Publisher provides the App with care. Under the ordinary rules of law, it is liable for damage caused by its failures to perform its obligations, and for the safety of the App, assessed in the light of its nature, described in article 7 and in the health and safety disclaimer.
It is not liable, however, for damage that is not attributable to it, in particular where it results from:
- a decision about the health, care, work or safety of a horse or a person, taken without the advice of the competent professional, contrary to the warnings displayed, or by following a suggestion that you should have adapted or set aside given your horse's condition;
- using the App instead of a vet, an instructor or the emergency services;
- inaccurate or incomplete information that you entered or validated, or use contrary to these Terms;
- loss of your content due to your phone, uninstalling, "Delete my data", the absence of a backup or forgetting the backup password;
- the acts, advice or decisions of the people with whom you share a horse and of the professionals you consult, or the content of third-party services (Platforms, weather, FFE or IFCE websites, your operator's network);
- force majeure (article 25).
In accordance with article 1231-3 of the French Civil Code, only damage foreseeable when the contract was concluded is owed under it, except in the event of gross negligence or wilful misconduct. As the App is not a monitoring service, failure to detect a warning sign or non-delivery of a notification does not in itself constitute a breach, unless the App is defective.
Nothing in these Terms is intended to or has the effect of excluding or limiting the Publisher's liability for gross negligence or wilful misconduct, for personal injury, or its liability for defective products, nor of depriving consumers of the rights granted to them by law, in particular the statutory guarantee of conformity and the right to compensation for harm caused by the Publisher's failure to perform its obligations. Your own liability (article 13) is only taken into account in proportion to your share in the damage.
25. Force majeure
The Publisher cannot be held liable for a failure resulting from force majeure within the meaning of article 1218 of the French Civil Code, in particular a widespread network outage, the failure of a host or an essential provider, a cyberattack, a natural disaster or a decision by an authority.
26. End of use and suspension
You may stop using the App at any time by uninstalling it. The "Delete my data" function erases your content from the phone and, if you are connected to the internet, the data our servers hold about your session, under the conditions of the privacy policy. Remember to cancel your subscription with the Platform: uninstalling does not cancel it.
In the event of a serious breach of these Terms (in particular abusive or automated use of Jo, illegal content shared, attack on the security of the service), the Publisher may, proportionately and after informing you where possible, suspend or restrict access to the App's online services (Jo, sharing). The emergency screen, the warning signs and the record stored on your phone are never restricted. You may challenge such a measure by writing to the Publisher.
27. Third-party services and links
The App and the website link to third-party services: Platforms, FFE and IFCE services, public services, weather service. These services are independent of the Publisher, which controls neither their availability nor their content. Their use is governed by their own terms.
28. Personal data
The processing of personal data is described in the privacy policy, which forms an integral part of these Terms.
29. Changes to these terms
The Terms may change, in particular with the App, an official rule or the law. The version in force is the one published on this website, dated at the top of the page. In the event of a significant change, the App informs you and asks you to accept them again before continuing; if you refuse, you may stop using the App and cancel your subscription; if you are a subscriber, the part of the price corresponding to the remaining period is then refunded on request. Changes do not apply retroactively, and do not change the price or the essential characteristics of a current subscription without your agreement.
30. Complaints and mediation
Any complaint may be sent to contact.equiflow@devolim.fr: we first seek an amicable solution and reply as soon as possible.
In-app purchases are concluded with Apple or Google, as sellers, who collect payment and handle refund requests under their own terms; DEVOLIM provides the service available in the App. See the terms of sale.
31. Governing law and jurisdiction
These terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts have jurisdiction. Consumers retain the right to bring proceedings before the courts of their place of residence. Consumers residing in another European Union member state retain the benefit of the mandatory provisions of the law of their country of residence.
32. General provisions
If any provision of these Terms were declared void, unfair or unenforceable, it would be deemed unwritten and the other provisions would remain in force. The Publisher's failure to rely on a breach does not constitute a waiver of the right to rely on it later. The Terms, the health and safety disclaimer, the privacy policy and, for the Premium Offer, the terms of sale constitute the entire agreement between you and the Publisher concerning the App. The Platform's terms also apply to downloading and purchasing.
33. Language
These terms are written in French. In the event of a discrepancy between the French version and a translation, the French version prevails.
